USA Peptide Sciences – Terms and Conditions

All products sold by USA Peptide Sciences are intended solely for laboratory research and development purposes.
Products are not intended for human or animal consumption, ingestion, administration, or therapeutic use of any kind.

Statements made by USA Peptide Sciences have not been evaluated by the U.S. Food and Drug Administration (FDA).
Products offered by USA Peptide Sciences are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Buyer represents and warrants that all products will be handled and used solely by qualified professionals with appropriate scientific training and expertise.
Buyer agrees that products will not be used for human or animal consumption under any circumstances.

Buyer agrees to use all products in accordance with applicable federal, state, local, and international laws, regulations, and guidelines.
Buyer further warrants that any products developed or derived from products purchased from USA Peptide Sciences shall not be adulterated, misbranded, or otherwise in violation of applicable law.

This Agreement shall be governed by and construed in accordance with the laws of the United States and the applicable laws of the state in which USA Peptide Sciences operates, without regard to conflict-of-law principles.

USA Peptide Sciences operates as a chemical and research materials supplier.
USA Peptide Sciences is not a compounding pharmacy, chemical compounding facility under Section 503A of the Federal Food, Drug, and Cosmetic Act, nor an outsourcing facility under Section 503B of the Act.

Buyer shall not provide, distribute, resell, repackage, relabel, or transfer products to any third party without prior written approval from USA Peptide Sciences.
If Buyer intends to transfer products to a third party, Buyer must provide complete identifying information regarding the intended recipient for review and approval before any transfer occurs.

This Agreement constitutes the complete understanding between the parties regarding the subject matter herein and supersedes all prior discussions, negotiations, and understandings.
Any amendment or modification must be in writing and signed by both parties.

Buyer acknowledges that products have not been tested by USA Peptide Sciences for safety or efficacy in food, drug, cosmetic, medical device, veterinary, or commercial applications.
Buyer assumes full responsibility for conducting all necessary testing, validation, and risk assessments before use.

Buyers must be at least twenty-one (21) years of age to purchase products from USA Peptide Sciences.

Buyer acknowledges that research chemicals and related products may present inherent risks.
Buyer certifies that through independent investigation and evaluation, Buyer is knowledgeable regarding:
- Health and safety risks associated with the products;
- Appropriate industrial hygiene and safety controls;
- Proper hazard communication requirements; and
- Applicable governmental regulations governing use, handling, transportation, and disposal.
USA Peptide Sciences reserves the right to refuse or limit sales to any purchaser at its sole discretion.

Buyer agrees not to knowingly publish or disseminate false or misleading statements regarding USA Peptide Sciences, its products, or services.
Any legal action arising under this Agreement shall be brought in the jurisdiction where USA Peptide Sciences maintains its principal place of business, unless otherwise required by law.
Each party shall bear its own legal costs unless otherwise awarded by a court of competent jurisdiction.

USA Peptide Sciences provides no instructions, warnings, specifications, and recommendations and buyer shall not knowingly misuse products.

By placing an order, Buyer affirms that all products will be used only in a lawful and appropriate research setting and that Buyer possesses the qualifications necessary to safely handle and utilize such products.

Buyer acknowledges and agrees that USA Peptide Sciences assumes no responsibility for improper use, handling, storage, transportation, or disposal of products.
Under no circumstances shall USA Peptide Sciences or its affiliates be liable for indirect, incidental, special, punitive, or consequential damages arising from the purchase or use of products.
Buyer agrees to indemnify, defend, and hold harmless USA Peptide Sciences from any claims, liabilities, damages, expenses, losses, or costs arising from Buyer’s handling, use, misuse, resale, distribution, or disposal of any products purchased from USA Peptide Sciences.

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect and shall be interpreted to best reflect the original intent of the parties.
